Practice by Non-Admitted Lawyers Before State Courts

Attorneys authorized to practice law before the highest court of record in any state, territory or country wishing to appear before a New Mexico court in a civil matter should consult the following rules:

Rule 24-106 NMRA
Practice by nonadmitted lawyers before state courts (Rules Governing New Mexico Bar)

Rule 1-089.1 NMRA
Nonadmitted and nonresident counsel (Civil Procedures)

Rule 12-302 NMRA
Appearance, Withdrawal or Substitution of Attorneys (Appellate Procedures)

Rule 24-106 NMRA
Compliance Procedures:

  1. Nonadmitted lawyers must file in association with an active member of the State Bar of New Mexico.
  2. Nonadmitted lawyers must be authorized to practice law before the highest court of record in any state, territory, or country.
  3. Nonadmitted lawyers must comply separately for each civil action, suit or proceeding in which the attorney intends to appear.
  4. Nonadmitted lawyers must file a Registration Certificate with the State Bar of New Mexico for each civil proceeding in which the attorney intends to appear.
  5. Nonadmitted lawyers must pay a non-refundable fee of $250 to the State Bar of New Mexico.

a. Payment must accompany the registration certificate
b. Payment can be in the form of check or credit card (see registration certificate)
c.  Nonadmitted lawyers may certify a waiver of the fee (see Rule 24-106 NMRA)

6.  Nonadmitted lawyers upon compliance with Rule 24-106 NMRA must consult the appropriate Rule of Civil Procedure Rule 1-089.1 NMRA or Rule of Appellate Procedure Rule 12-302 NMRA to complete the admission process with the Court.
