Real Property, Trust & Estate Section
The general purpose of the Section shall be the promotion of the objectives of the State Bar of New Mexico within the particular fields designated by the name of this Section. To that end, the purposes of this Section shall include:
A. The consideration of all matters of legal interest relating to the various subjects covered by the respective committees and divisions; and to communicate, through the State Bar Bulletin and otherwise, with the members of the Section respecting these matters;
B. The study of the law relating to interests in real property, title thereto and transactions therein, and of the possibilities of increased uniformity in such law, and of improvements and reforms in such law and in title and recording practices, through legislation, title standards or otherwise; and
C. The consideration of the various questions with reference to wills, the creation and administration of estates, the relation of probate court jurisdiction to general judicial administration, the subject of trusts in all its various aspects, including the subjects of the creation of trust estates, trustees and their powers and duties, trust companies and their relationship to the trustors, beneficiaries and the public, and social and economic aspects of the trust, the investment, control and protection of trust funds, the function of the various forms of trusts created, the advisability of other specific probate or trust statutes or rules, the possibility of increased uniformity in the various aspects of the probate and trust law, pending legislation and current literature in the field, noteworthy probate and trust statutes and decisions and other matters of interest concerning probate and trust law.
